By accessing or using the CheckTown website at check.town (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms form a binding agreement between you and CheckTown. We reserve the right to update these Terms at any time. Continued use of the Service following any changes constitutes acceptance of the revised Terms.

2. Description of Service

CheckTown provides free, web-based validation tools that allow you to verify the format, structure, and deliverability of various data types, including:

• Email addresses — syntax validation, domain verification, MX record checking, and deliverability assessment.
• IBAN numbers — format, checksum, country code, and bank identification validation.
• BIC/SWIFT codes — format validation and institution lookup.
• Phone numbers — format, country code, and carrier/type identification.
• VAT identification numbers — format validation and, where available, official registry verification.
• Postal addresses — format validation and, where available, geocoding-based verification.

The Service is provided free of charge without requiring user registration or account creation. We reserve the right to add, modify, or remove features at our sole discretion.

3. Free Access and Fair Use

CheckTown is freely accessible to all users. To ensure equitable access for everyone, we apply rate limiting based on IP address. Excessive automated requests may result in temporary blocking of your IP address without prior notice.

We reserve the right to introduce usage quotas, API keys, or paid tiers in the future. Any such changes will be communicated in advance through the website.

4. Acceptable Use

You agree to use CheckTown only for lawful purposes and in a manner consistent with these Terms. Acceptable uses include:

• Validating data in the course of your normal personal or business activities.
• Integrating results into your own applications for data quality purposes.
• Educational and research purposes.
• Testing and development, subject to our rate limits.

5. Prohibited Activities

You agree not to engage in any of the following:

• Automated scraping — using bots, scripts, or automated tools to send requests in volumes that exceed normal human usage or that circumvent rate limiting.
• Reselling the Service — repackaging or reselling CheckTown's validation results as your own data product without our written consent.
• Malicious use — using the Service to facilitate spam campaigns, phishing, fraud, or any other illegal or harmful activity.
• Interference — attempting to disrupt, degrade, or overwhelm the Service through denial-of-service attacks or any other means.
• Reverse engineering — attempting to extract, reverse engineer, or decompile any part of the Service's backend logic.
• Harvesting personal data — using the Service to harvest or enumerate personal data about third parties without their knowledge or consent.
• Legal violations — using the Service in a way that violates any applicable law, including data protection laws (such as GDPR or CCPA).

We reserve the right to suspend or permanently block access for any user who violates these prohibitions.

6. Intellectual Property

The CheckTown name, logo, website design, and all underlying technology are the intellectual property of CheckTown and are protected by applicable copyright, trademark, and other intellectual property laws.

You retain full ownership of any data you submit for validation. You grant CheckTown a limited, non-exclusive, royalty-free licence to process your submitted data solely to perform the validation and return the result. This licence expires immediately once the result is delivered.

You may not copy, reproduce, distribute, or create derivative works based on any part of the Service without our explicit written permission.

7. Disclaimer of Warranties

CheckTown is provided "as is" and "as available" without any warranty of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Warranties that the Service will be uninterrupted, error-free, or free of viruses or harmful components.
• Warranties as to the accuracy, completeness, or reliability of any validation result.

Important: Important: Validation results are provided as a best-effort tool to assist with data quality. They should not be relied upon as the sole basis for financial, legal, medical, or other high-stakes decisions. Always verify critical data through official channels (e.g., your bank, official government registries).

8. Limitation of Liability

To the maximum extent permitted by applicable law, CheckTown and its operators shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, goodwill, or business opportunity.
• Damages resulting from your reliance on any validation result.
• Damages resulting from unauthorised access to or alteration of your data.
• Damages resulting from service interruptions or downtime.

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability is limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless CheckTown, its operators, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the Service in violation of these Terms.
• Your violation of any applicable law or regulation.
• Your infringement of any third-party rights.

CheckTown may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party sites. Links do not constitute endorsement.

Our validation tools may rely on third-party data sources (such as public IBAN/BIC registries or DNS lookup services). We do not guarantee the accuracy or availability of these external sources.

11. Modifications to Service and Terms

We reserve the right to modify, suspend, or discontinue any part of the Service at any time and without prior notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

We may revise these Terms at any time. The updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Service constitutes acceptance of the new Terms.

12. Termination

We may, at our sole discretion, terminate or suspend your access to the Service immediately and without notice if we determine that you have violated these Terms, abused the Service, or engaged in any activity harmful to CheckTown, other users, or third parties.

Provisions that by their nature should survive termination — including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Governing Law — shall survive.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the European Union and the applicable law of the country in which CheckTown operates, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be submitted to the competent courts of the jurisdiction in which CheckTown is registered.
